The new rules governing meaningful use of EHRs will set the basis for health data privacy and security practices. Although the proposed HIPAA privacy and security regulations will exert significant influence, at the end of the day the technology and policy requirements imposed on by CMS and ONC establish baseline requirements and capabilities that healthcare organizations will have to meet.

For example, a key challenge that continues to be underappreciated is how these regulatory initiatives have already created new expectations for more robust patient rights.

The EHRs regulations and the proposed HIPAA privacy and security requirements are inextricably connected. That means privacy and security officers must understand and participate in the business decisions related to the EHR adoption within their organizations.

Whether or not a healthcare organization seeks the CMS incentives for adopting EHRs does not matter. HHS estimates that 527,254 healthcare providers will be participating in the EHR incentive program. That massive adoption alone will create enough critical mass within the next five years to establish the real world of privacy and security requirements for all HIPAA covered entities

Healthcare compliance officials and senior managers should understand how the EHR and HIPAA initiatives relate to ensure proper functioning of their operations and avoid regulatory problems later. EHR vendors may mean well when they say that their systems will take care of privacy and security issues, however, the ultimate responsibility for ensuring HIPAA compliance still falls on healthcare providers and their business associates. Privacy and security compliance remains an issue met only when technology and policy are integrated.

Dennis Melamed is editor and publisher of Health Information Privacy/Security Alert and an adjunct professor at the Drexel College of Medicine, where he teaches master's level courses on patient data stewardship. He recently  has served as a consultant for the National Governors Association's Center for Best Practices, where he focused on  privacy and security issues surrounding health information exchanges.
